Aspectos jurídicos del voto electrónico y las garantías de la integridad del proceso electoral

Abstract

The unstoppable zeal for applying the new technologies to the political elections, relying on the most diverse motivations, carries the need to check the current mechanisms of guarantee of the principles of the democratic suffrage to assure that this one will continue being universal, free, equal, direct and secret, be which is the procedure used for its expression. It is necessary, before the future that one approaches, that the guarantees that are foreseen by the electoral legislator apply to themselves not only to the procedure of voting but also to the previous and preparatory phases and in the moment to realize the scrutiny and to present eventual challengings to the electoral results. In the present article it is underlined which are the principal problems to which there will be necessary to face and suggests some juridical solutions that can inspire the future legislation.
