Abstract

Electoral reforms traditionally happen as a result of a legislative process where it is necessary to find political majorities for their approval. These legislative processes are generally reduced to a closed discussion between political parties without the citizenry having a preponderant role. It is considered essential that citizens have an impact on their electoral system, however, this has not been achieved through legislative processes but through the justice path. In this essay, the citizenship-electoral justice binomial is analyzed as an ideal way to achieve positive changes to an electoral system without the need for legislative reforms. In this sense, strategic litigation can be a relevant tool to have more inclusive and democratic electoral systems.
