  • Abstract

    The gradual establishment of electronic voting need to argue the adequacy of legal regulation with the principles and constitutional rights, particularly those related to the principle of democracy and the right to vote. Although without the same implementation and possibilities at present, there is a problematic analogy between presential electronic voting and remote electronic voting that needs to be analyzed from the Constitution. This article is a first approach to constitutional considerations of electronic voting and the relationship with the democratic principle, and analyzes the main jurisprudence emanating from the supervisory bodies of the German and Austrian constitutionality in recent years..
