El financiamiento público directo. Una propuesta de sanción proporcional y razonable

Abstract

After over two years since the sanction for the loss of direct public financing in 2015 to three Peruvian political parties, all declared null by the JNE, the cases are re-examined to elaborate a proposal for a sanction based on the constitutional principles of proportionality and reasonableness applicable to political parties that do not submit their Annual Financial Information. Currently, political parties are under constant scrutiny from public opinion, exposed to the evaluation of the media and, when economic power surpasses political power, their noble functions are denaturalized, which weakens the democratic system, since it tends to corrupt those who hold political representation and takes them away from their true purposes within a democratic political community. That is why this paper seeks to answer the following questions. What are the criteria to take into account when imposing sanctions? should the sanction necessarily be adjustable? what is the importance of the annual financial report? This essay will propose an alternative formula, predictable and equitable with the interests of political organizations for the benefit of democracy in Peru.
