La definición de candidato y su relación con el artículo 36-B de la Ley de Organizaciones Políticas

Abstract

A measure of strengthening democracy is to verify whether campaign contributions directed at political parties come from prohibited sources, for which ONPE carries out the verification of income, contributions and expenses incurred by candidates during the electoral campaign. In that sense, once the electoral process is finished, the first step is the presentation of the information by the former candidates, without the Peruvian legislation having defined who are “candidates”; therefore, this article seeks to analyze who would be required to present the Campaign Financial Information (in particular during the ERM 2018); and a proposal is presented on how to apply the sanctions in the most objective way possible.
