La doble dimensionalidad del derecho de sufragio pasivo: alcances y límites a su ejercicio

Abstract

This study is in the field of constitutional law and political science, specifically in the lines of research referred to electoral law and political participation rights. On the occasion of the electoral and political reform initiated in Peru, the main objective has been the construction of a contextual framework of the scope and limits of the right of passive suffrage based on the conception of the double dimension of fundamental rights. For this, we will organize the conditions for the exercise of the right of passive suffrage in: general or formal requirements, capacity or qualification requirements, eligibility or compatibility requirements, and finally the —which we have called— electoral system requirements.
