El control constitucional de las resoluciones electorales en el Perú

Abstract

This paper examines the boundaries between constitutional law and electoral law in the application of criteria that guarantee political participation and which, in turn, fulfil the requirements needed to ensure the freedom and equality of the electorate’s suffrage. The author takes a broad concept of democracy, which exceeds the narrow conception of considering it only as an electoral method and a set of rules that organize the elections. This broad concept allows constitutional criteria to be applied in this regard. The article refers to the resulting debate in Peruvian law and its institutions.
